Passenger rights in Spain

Any passenger traveling by plane has certain rights under the law. These rights apply regardless of your destination, origin and company with which you travel. What can I do if my luggage is lost or damaged?

There is a document called Baggage Irregularity Report (PIR), whose existence is defined by the right of every passenger to collect their luggage as it was deposited. That is, every person has the right to maintain the integrity of their luggage.

If you detect any incident related to your luggage, you must immediately request this document. In the same way, you will have to resort to it in case it has been lost.

Filling out this document is an essential requirement to report the incident and for the airline to process it. You must request and fill out the Baggage Irregularity Report at the Handling Corporation counter. You will also have the opportunity to request it at the counter of the airline responsible for the flight. Later, the airline will process the corresponding compensation.

Passenger’s right to boarding

An airline may prevent a person from boarding only for reasons of health, safety or for not showing the necessary documentation to travel. In other words, as long as the person has bought their ticket, they will have the right to board and travel on the corresponding plane.

If the airline prevents boarding for other reasons (for example, overbooking), the passenger will enjoy the following rights:

  • The passenger has the right to assistance.
  • To be compensated immediately (this being understood that the person does not have to carry out any additional procedures to be paid said compensation).
  • The passenger will have the right to be provided with an alternative transport or to a refund of the price of the flight.

Depending on whether the arrival of the alternative flight is less than 2, 3 or 4 hours, and depending on the distance of the flight, the remuneration varies.

  • More than 3000km: compensation of 600 euros (in case the alternative flight arrives in less than 4 hours, the compensation decreases by 50%).
  • A compensation of 400 euros is established for intra-community trips of more than 1,500 kilometers and all other flights between 1,500-3,000 km. However, this compensation can be reduced to 50% in case the alternative plane arrives before 3 hours.
  • Up to 1,500 kilometers: compensation of 250 euros (50% less if the alternative flight arrives in less than 2 hours).

Do I get my money back if my trip is delayed or cancelled?

The rights enjoyed by passengers who have a ticket for canceled or delayed flights are the following:

  • The passenger has the right to be informed about the situation.
  • The passenger has the right to assistance.
  • Under the same conditions as in situations of denied boarding, the person has the right to have an alternative transport or the payment of the ticket.
  • Right to be compensated (except for extraordinary circumstances).

In the event that the flight is delayed by three or more hours, the passenger may request a refund under the same conditions as for cancellation. However, these compensations will not apply if the airline can prove that the delay is due to an extraordinary circumstance.

The corresponding compensations are determined based on the distance of the trip, provided that the delay is at least three hours or more.

In the event that an airline forces you to travel in a lower class than the one paid for, the airline will have to reimburse a percentage of the cost of the ticket.
